M-9 CITY OF CHENEY, WASHINGTON AN ORDINANCE providing far environ- mental protections upon new construction within the city, providinq for mandated buffering where such is necessary to protect the quality of the neighborhood, establishing far securing compliance herewith, and providing for an effective date hereof. THE CITY COUNCIL OF THE CITY OF CHENEY, WASHINGTON, DO ORDAIN AS FOLLOWS: Section 1. There is hereby established o new subsection .051 of Title 10, Chapter 10.08, of the Cheney City Code to read as follows: 10.08.051 Procedure to be Followed - Mitigation of Adverse Impact. a) Whenever an environmental checklist s required ta be completed, the applicant shall present the same to the official or office responsible for issuance of the permit, license, certificate or other entitlement. b) The official receiving the checklist shall endorse the checklist and recommend thai an environmental impact statement not be required (negative impact) unless matters disclosed in the report or otherwise known Io he official and properly requiring an environmental impacl statement indicates an affirmative recommendation should be made. This shall be stated in the appropriate space provided on the checklist. c) The officia receiving the checklist upon recommendation that no environ- mental impact statement be completed shall then determine whether or not the proposed construction, while not requiring an environ- mental impact statement, wi[[ still result in any noise, light, odor or other such environmental impact as is not then in approximately the same level common to the general area of the proposed use. Upon an affirmation determination thereof such shall be noted on the checklist for further action as hereinafter required. d) All checklists shall be reviewed by the building official, fire chief, and planning coordinator or the representative of each, prior to being submitted to the responsible official. Each such official shall endorse the checklist and either recommend or not recommend thal an environmental impact statement be required. Upon a negative recommendation each shall assess the proposed construction as staled in subsection c), and note whether environmental impact as therein stated will result, PROVIDED that if the planning coordinator shall indicate that there will be such impact, he shall further specify what impact is likely ta occur and stale what buffering or other protective measures, if any, would substantially reduce any such impact, and the feasibility of requiring such of the applicant. Section 2. There is hereby established a new subsection .052 of Title 10, hapter 10.08 of the Cheney City Code to read as follows: 10.08.052 Responsible authority's action where no environmental impact statement required and environmental impact present. a) The responsible authority, or his representative, shall review every environ- mental checklist. If a negative impact is cletermined for purpose of an environmental impact statement, then a determination shall be made whether or not the proposed construction or use will result in any noise, liqht, odor or other such environmental impact as is not then in approximately the same level common to the general area of the proposed construction and use. b) Upon an affirmative finding pursuant 1o subsection a), the responsible official snail edter I) prescribe buttering or other acts to be included prior to issuance of a permit, or 2) forward the checklist to the Planning Commission which shall, upon notice published one time at least 10 days prior thereto, conduct a public hearing and make recommendations thereafter to the responsible authority as to buffering or other acts necessary to mitigate adverse effects, or 31 approve the checklist whereupon a permit shall issue without requiring any mitigating act, but only upon a determina- tion that the impact is not sufficient to warrant any corrective action. Section 3. There is hereby established a new subsection .053 of Title 10, Chapter 10.08 of the Cheney City Code to read as follows: 10.08.053. Responsible official em- powered to require buffering to mitigate environmental impacts. If the responsible official determines that it is in keeping with the welfare of the community that acts be taken to mitigate any adverse environmental impact likely to be created by any development, then he shall specify such acts as may be necessary, and no building permit shall issue except upon such buffering or other act being provided for in the building plans. Until such buffering is in place no occupancy permit shall be issued, and if such buffering be removed or allowed to deteriorate so as to lose a substantial part of its intended effect, then the code enforcement officer shall revoke any occupancy permit. Upon revocation of an occupance permit, the structure for which it was issued shall not thereafter be occupied until such time as o new occupance permit is issued. Section 4. There is hereby established a new subsection .054 of Title 10, Chapter 10.08 of the Cheney City Code to read as follows: 10.08.054. Buffering measures. Measures to be used to buffer may consist of, but are not limited to, one or more of the following: a) sight obscuring measures including fences, landscaping, berms, or buildings located so as to block visibility; land- scaping shall be planted and sized to provide a solid screen to a minimum height of six feet within three years after planting; the finished side of all fences shall face the outside of the builder's property; b) noise reducing measures, including restriction of activities to certain hours, fences, berms, or buildings located to block noise; c) glare reducing measures, including location of outside area lighting, approval of outside lighted signs, fencing and landscap- ing; d) traffic regulating measures, including designation of points of ingress and egress, signing, design of roadways and parking areas, exclusion of certain vehicles, and construction of sidewalks; e) safety and health measures, including security fencing, and exclusion of storage of certain hazardous materials; f) measures which limit the amount of odor, dust, suspended particulates and other airborne materials which reduce air quality. Section 5. There is hereby established a new subsection .055 of Title 10, Chapter 10.08 of the Cheney City Code to read as follows: 10.08.055. Appeal. Any applicant aggrieved by a decision to the responsible official requiring buffering shall give notice to the city administrator whereupon a date and time shall be set within 60 days whereupon the aggrieved applicant shall appear before the city council and be heard. The council shall be majority vote either to approve the requirement imposed by the responsible authority, or modify or reject those requirements. The decision of the city council shall not be subject to review except as may be permitted by law. Section 6. This ordinance shall be effec- tive five days after adoption, approval, and publication.
